Terms of Membership

These Terms are a binding agreement between you and Heredity. By submitting an application, clicking “I agree,” or enrolling in a paid membership, you accept these Terms, the Privacy Policy, and the Medical Disclaimer.

1. What Heredity is, and is not

Heredity is a membership program that facilitates your access to clinical consultation with independent, licensed healthcare professionals and to fulfillment by independent, licensed U.S. pharmacy partners, subject to clinical eligibility and approval.

Heredity is not a pharmacy, a prescriber, a medical practice, or a healthcare provider. Heredity does not practice medicine, does not diagnose, treat, cure, or prevent any disease, does not dispense medication, and does not write prescriptions. All clinical decisions are made independently by licensed clinicians; all compounding and dispensing is performed by licensed pharmacies. Nothing is provided unless a licensed clinician determines it is clinically appropriate and, where required, issues a valid prescription. Your payment of membership fees does not entitle you to any specific outcome, recommendation, prescription, or product.

2. Eligibility

You represent that you are at least 18 years old, a U.S. resident located in a state where the service is offered, applying on your own behalf, and providing true and complete information. Membership is by application only. We and our clinical and pharmacy partners may approve, condition, decline, suspend, or revoke any application or membership for any lawful reason. Approval is not a clinical determination and does not guarantee any clinician will recommend or prescribe anything.

3. Subscription, fees, and billing

Membership is a paid, recurring, auto-renewing subscription. Plan options and pricing are presented at enrollment. Your payment method is charged at enrollment and automatically on each renewal date thereafter until you cancel. Payments are processed by our third-party processor (Stripe). [If medication costs are separate from the membership fee, that is disclosed at checkout and billed separately.] We may change fees with advance notice as required by law; changes apply to the next renewal.

4. Automatic renewal and how to cancel

YOUR MEMBERSHIP AUTOMATICALLY RENEWS. Unless you cancel, it renews at the end of each billing period and your payment method is charged the then-current price on each renewal date. You may cancel at any time, and cancellation is as easy as enrollment: online through your account, with no requirement to speak to anyone. Cancellation stops future renewals and takes effect [at the end of the then-current billing period / immediately]. Where required, we send a renewal reminder before each renewal.

5. Refunds

[Membership-fee refund policy to be finalized, e.g., a full refund of the first fee if you cancel within [X] days and have not used the consultation.] For health and safety reasons and as required by law, dispensed medications and compounded products are not returnable or refundable once shipped, except in the case of our or the pharmacy's error or a defective product.

6. Disclaimers and limitation of liability

The service is provided “as is.” To the fullest extent permitted by law, Heredity disclaims all warranties and does not warrant any health, medical, or other result, or the services of any clinician or pharmacy. To the fullest extent permitted by law, Heredity will not be liable for indirect, incidental, special, consequential, or punitive damages, and its total aggregate liability will not exceed the greater of the fees you paid in the prior [6/12] months or $100. Nothing limits liability that cannot be limited by law. This does not limit the independent liability of clinicians or pharmacies for their own professional acts.

7. Dispute resolution; arbitration; class-action waiver

[Most disputes are to be resolved by individual binding arbitration, with a jury-trial and class-action waiver and a 30-day opt-out, governed by the Federal Arbitration Act. Final language, forum, and carve-outs (small claims, injunctive relief for IP) to be confirmed by counsel.] Please read this section carefully before accepting these Terms.

8. Changes, governing law, and contact
